Wrongful Death Attorneys

A wrongful death claim is a lawsuit brought on behalf of the survivors of a deceased individual for damages resulting from their loved one’s unjust, untimely, or unnecessary death due to the negligence or carelessness of another individual, product, or company.  According to statistics released by the Federal Bureau of Investigation (FBI), there were 17,034 wrongful deaths that were deemed homicide or otherwise non-negligent in the United States during the one-year study.  Aside from this total, the study also cited countless other wrongful deaths that occurred and resulted in civil reparations and restitution to the families of the deceased individuals.

A wrongful death case may be defined as any of the following:

  • A negligent or careless act such as an inattentive driver
  • A motor vehicle/trucking accident caused by a defective equipment
  • Death due to a reckless or irresponsible act by another person
  • Intentional and/or deliberate act of violence such as murder, assault, and/or battery
  • Unintentional death in the course of another crime
  • Unintentional death during a medical procedure
  • Death due to neglect of a doctor, hospital or nursing home
  • Defective drugs or wrong medication
  • Negligence in the enforcement of safety regulations
  • Use of faulty equipment or tools
  • A negligent property owner who fails to meet safety regulations

The person who is allowed to file a wrongful death claim varies by jurisdiction.  It depends largely on state statutes but generally, the immediate family members (spouse, children, and parents) are the legitimate claimants allowed to pursue a wrongful death claim.  Some states may allow extended family members (grandparents, dependents, or other extended family members) to bring a wrongful death claim against the guilty party.

A wrongful death case can reach settlement in pre-trial conference or the case may go on to trial.  Large-scale wrongful death cases frequently go to trial before a jury.
