Select the type of Lawyer you need
If you are considering filing a personal injury claim, you probably want to know in advance exactly how injury personal lawyers get paid. This can significantly impact your actual compensation in an injury case. While there are industry norms for how personal injuries collect fees, each attorney's practice may vary, and you should consult the attorney you are considering hiring about specific fee agreements and get your fee arrangement in writing.
Personal Injury Lawyers on Contingency
Personal injury lawyers accept cases on a contingent fee basis usually. This means that they if they win a settlement or in court, they collect a percentage of the amount they collect; however, if they lose, they do not collect an attorney fee. While this is a standard personal injury attorney fee structure, you may be responsible for paying certain costs such as filing fees and other legal expenses in the event your attorney is unable to get compensation for you.
The amount of the contingency fee your attorney will collect may be anywhere between 30 and 40 percent of your personal injury award. Because different law governs worker's compensation cases, the fees may be lower in such cases. You might be able to negotiate a smaller contingent fee depending on your case; however, many personal injury lawyers are not willing to negotiate their fees. It is important to hire a skillful attorney to handle your personal injury case since negotiating and trial experience are musts. Your attorney can make the difference between you receiving the compensation to which you are entitled and you walking away injured and without any recourse.
You should be given a fee agreement that covers how much and in what way your attorney will be paid when you hire your attorney. This agreement should clearly state any potential fees in your case.
