I got into a snowboarding accident with someone else that crossed my path and suffered severe injuries. Can I sue them?
My son was in a snowboarding accident with someone else several weeks ago. He was skiing down the bunny hill slowly, and just learning. This person who hit him was completely out of control, going way too fast and not paying attention to where he was going. He was fooling around with his friends and collided into my son, breaking his arm and his leg and causing a serious concussion that led to swelling in the brain. My son has been in the hospital for weeks and, in addition to being worried about him, I’m worried about money too since the bills are huge. Can we sue the person who caused the accident? We have his name and address from the ski resort who filed a report, and the report from the ski patrol says that the other skier was being very reckless.

Skiers, like any other individuals, have a duty to exercise a reasonable degree of care to avoid injuring others. In skiing, this usually means that skiers or snowboarders have an obligation to maintain reasonable speed and to avoid behaving in a reckless or dangerous manner on the slopes. If the person who injured your son breached this duty by skiing too fast or behaving recklessly, you may be able to file a personal injury lawsuit for the accident and recover for damages for injuries due to the snowboarding accident. You should collect any evidence you have, including witness statements and the report from the ski patrol.
