What do I do if the EMS paralyzed my son?

My son was recently in a car accident.  One of the EMS guys failed to properly secure his neck while moving him onto a back board.  Now he is paralyzed from the neck down as a result.  A few days later at the hospital, the EMS crew came to me and apologized for what happened.  Now they are denying any responsibility.  What can I do?

Your first step should be to get a good attorney that handles medical malpractice claims.  Although emergency medical personnel have greater latitude than some doctors because of the manner in which they work, malpractice still takes place and should not go unchecked.  Once you have an attorney and your son’s case is evaluated, the EMS crew should be deposed or interviewed on the record.  It is very likely that the company which they work for is denying liability even though the individual crew members know they acted negligently.  Your attorney will need to speak to them and get their story to know how to proceed with the claim.  It is very likely that you may have a valid case against the EMS company even though they deny liability.
