Q: What if I want to make an accident claim for compensation on my injuries?
A: You may be eligible for compensation for your accident claim if the other party is responsible and found at fault. The claim may cover your personal injuries, pain & suffering, vehicular damages and other indirect expenses which may have resulted from the accident. The claim should be filed with the other driver's insurance as soon as possible. However, if you are offered an amount t settle the claim, make sure to speak with an accident attorney before you sign any documents which would release liability.
If you are compelled to bring suit against the other party, do not wait. There is a statute of limitations on the filing of accident claims. Under normal circumstances, the statute is from one to two years, However, it may be far less so you must not postpone your actions. If the amount of the damages $5,000 or less, the matter may be seen in a small claims court. In a small claims suit, you do not need the representation of counsel.
If however you are going to file a suit for a sum greater than $5,000, you will need to be represented by an accident attorney.
Accident attorneys do not ask for a fee before they represent you. For personal injury cases, they take the case as a contingency. What that means is that you pay the attorney after the case is settled. if you do not win the the case, you owe the attorney nothing. If you win your case, the fee will be a set amount that you and the attorney agree to prior to representation. A typical fee is around 30% of the award. There may be a sliding fee schedule in the event that the case is settled before going to trial.
Q: What if someone sues me for an accident compensation claim?
A: If someone sues you for an accident compensation claim what you should do is contact your insurance agent and/or your accident attorney right away. If you don't have an accident attorney you can contact one here.
Normally, your insurance provider assigns an company attorney to handle the case. However, if suit is filed for a larger amount then your policy allows, you will need to contact your own accident attorney. In this event, you may have to pay the attorney a retainer before representation.
Q: Should I be seen by a doctor after the accident?
A: Seeing a doctor is always a good idea for both you and your passengers. You may be injured and not be aware of any problems immediately. It is suggested that at the very least you call your physician health care provider to get a release for a good bill of health. You insurance coverage should be able to pay for your hospital charges.
