Workman’s comp law is designed to ensure that employees who are injured or disabled on the job (work place accident) are provided with fixed monetary awards, eliminating the need for litigation.  These workers' compensation state laws also provide benefits for dependents of those workers who died because of work place accidents or illnesses.  All states implemented some form of workers’ compensation laws by 1949, and fast forward to March 2008, 153.8 American workers are under the benefits of workers’ compensation.  In some cases, proper benefits after an injury on the job or from job related accidents are not paid out or insufficient compensation is awarded.

Workers compensation laws establish a comprehensive framework that most employers follow to provide relief to victims of on the job accidents, illness, or death.  Federal statutes outline the specific details of benefits for federal employees and workers that are employed within a governmental organization.

Other similar programs include:

  • The Federal Employment Liability Act (FELA),
  • The Merchant Marine Act (the Jones Act)
  • The Long shore and Harbor Workers' Compensation Act (LHWCA)
  • The Black Lung Benefits Act

The Federal Employment Compensation Act provides workman’s compensation for federal employees and non-military civilians.  The benefits of Workers Compensation are limited to when disability or death has been sustained during the performance of an employee's duty and yet is not caused by a willful act on the part of the employee.
